Terms and Conditions of Business

1. Clients MUST inform AC Transport Training Ltd if they have any endorsements or convictions on their license prior to booking any driver training courses. Failure to do so may event in course bookings to be being cancelled and deposits forfeited. AC Transport Training Ltd shall not be held legally responsible for this action taken against students.

 

2. Cancellation or transfer of an agreed course booking by a customer prior to 15 days of commencement of the course date will incur an administration charge. The cancellattion/administration charge will be 25% of the total course fee plus VAT, and any non-recoverable examination fees. Refunds will be processed within 90 days after refund amount is agreed between AC Transport Training Ltd and the Client in writing.

 

3. Cancellation or transfer within 15 days by a customer prior to the course commencement date will result in the whole course cost being forfeited. This also relates to any reasons for cancellations stated in paragraph 17 of these terms and conditions.

 

 3a. Cancellation within 15 days by a customer prior to course commencement date are still subject to full course costs being paid, if non-payment then AC Transport Training Ltd may recover using other methods which may incur additional costs. These costs would be added to the outstanding balance.

 

4. Substitution of course delegates, subject to examination board criteria, will be accepted upon reasonable notice being given, and the original booking and fee will be deemed to be accepted.

 

5. A 25% deposit is required at the time of booking which will be forfeited if a course has not been booked within 6 months of the deposit received date. All training courses/packages have a 6 month (182 days) expiration date from initial booking date, should a training course/package exceed 6 months (182 days) the client would forfeit any monies paid which would result in course/ training package being terminated without refund. Courses/ training packages may be extended at the discretion of AC Transport Training Ltds Managing Director and must be agreed in writing. Should uncontrollable/ unexpected factors cause a client’s delay; then these uncontrollable/unexpected factors must be provided to AC Transport Training Ltd in writing at the earliest opportunity and prior to the course/ training package expiration date, these factors would not mean automatic extension of course/training package and must be agreed upon by our Managing Director.  Payment of all course fees must be made in full 15 days prior to the commencement of the course unless other arrangements have been mutually agreed with AC Transport Training Ltd. Cheques accompanying booking should be made payable to AC Transport Training Ltd. AC Transport Training Ltd reserves the right through non-payment by the customer 15 days prior to the course to cancel the booking and offer the position elsewhere.

 

6. Any variations to the booking course date, time of attendance, etc. made by AC Transport Training Ltd will be notified to the customer. AC Transport Training Ltd will make every effort to ensure that the original instructions are complied with. In the event of course/delegate cancellation made by AC Transport Training Ltd, every endeavor will be made for the delegate to attend the next available course. All incidents and actions, including any money refunds, are dealt with promptly and fairly within AC Transport Training Ltd Quality Management System. AC Transport Training Ltd reserve the right to update or amend these Terms and Conditions (Ts & Cs) at any time and that the Ts & Cs prevailing at the time of enquiry applies – this is in accordance with law and does not affect a Trainee’s statutory rights.

 

7. Every effort is made to ensure that both the instructions and handouts/course notes are true and correct at the time. AC Transport Training Ltd does not accept responsibility for any errors or omissions.

 

8. Any delegate attending AC Transport Training Ltd premises, including vehicles, are required to adhere to any notices or instructions given to them by AC Transport Training Ltd staff. AC Transport Training Ltd does not accept responsibility for personal belongings or vehicles left on or off the premises.

 

9. Where external examinations are involved and details have been supplied by the delegate for enrolment, AC Transport Training Ltd cannot accept responsibility for the accuracy if a dispute should arise with the examinations body.

 

10. It is important that adequate provision is made to ensure that drivers attending courses are able to comply with the rest requirements laid down in Drivers’ Hours Regulations.

 

11. All delegates must comply with AC Transport Training Ltd ‘s Safety Policy and their legal obligations under the Health & Safety at Work Act 1974 and other relevant provisions.

 

12. If you are attending a driver training course and you have a collision (RTC) in any of the AC Transport Training Ltd vehicles and it is deemed to be your fault the course will be terminated immediately with no refund. Any near miss or “close call” incidents would be at the discretion of the instructor whom has the right to terminate any training should they deem this the most suitable action for self-preservation and public safety. Any tests would be forfeited should the trainee/candidate not be a suitable standard to drive the vehicle without the risk of causing serious harm/damage to persons or property.

 

13. Driver Training packages (Zero to Hero Cat C), if not paid in full on booking must pay a minimum of £462.50 deposit and the remaining balance can be spread over 3 more equal payments of £462.50, split at calendar month intervals. However, any outstanding balance must be paid 2 weeks before commencement of the driver training. Course/Package commences as soon as package/appointment are booked.

 

13a. Driver Training packages (Zero to Hero Cat C+E), if not paid in full on booking must pay a minimum of £725.00 deposit and the remaining balance can be spread over 3 more equal payments of £725.00, split at calendar month intervals. However, any outstanding balance must be paid 2 weeks before commencement of the driver training. Course/Package commences as soon as package/appointment are booked.

 

13b. All Zero to Hero Driver Training Packages have an expiry of 6 months from the time of booking. If the course is not completed within those 6 months, the course will be cancelled and all monies paid will be forfeited, subject to part 5 of terms and conditions of business.

 

14. If any payments are missed the individual has 2 days (48 hours) to contact AC Transport Training Ltd and to clear the outstanding amount or AC Transport Training Ltd reserves the right to cancel the training with the individual forfeiting all monies paid if within 15 days’ term 3a. applies.

 

15. Any abuse or disrespect to a Member of Staff, Instructor, DVSA Examiner or another pupil(s) will not be tolerated and will result in cancellation of any course with no refund given, AC Transport Training Ltd does not have to provide written/verbal or otherwise reasoning for this decision. AC Transport Training Ltd may look to take legal/civil actions should it be necessary.

 

16. If during driver training, your instructor believes that your driving ability and concentration is affected by fatigue, he/she may deem it appropriate to take a driving break for the student.

 

17. Any student under the influence of Alcohol/drugs will have their training immediately cancelled. If the instructor deems you to be a danger to other road users, pedestrians or the instructor themselves then any further training will be cancelled.

 

18. All candidates attending any classroom-based course must participate during the course. Failure to do so could resort in the said candidate being removed from the course.

 

19. Any person or persons attending a CPC course may not leave earlier than 7 hours of each day (excluding breaks) as this is legislation required, this will result in the CPC hours not being uploaded and the individual may be removed from the course.

 

20. Under no circumstances should dirty/soiled clothing be worn during any AC Transport Training Ltd course. Any student found wearing dirty/soiled clothing may be asked to find a change of clothes at their own expense before continuing their training.

 

21. If a payment plan is required between you (the customer) and AC Transport Training Ltd (the company) then the terms will be a deposit of 25% of the total course fees then the remaining amount paid over the course of 3 monthly payments of equal amounts from the customer to the company unless otherwise agreed by the company. All payment plans entered into between the customer and the company is a legal contract and any missed payments will apply to section 14 & 3a of Terms and Conditions of Business, resulting in all monies paid being forfeited by the customer and any outstanding /remaining balances being recovered including any additional costs such as but not limited to, claim recovery services.

 

22. Should a candidate not be successful in the 3A Off-Road maneuver test and have a 3B on-road test in place, the candidate would forfeit the 3B on-road test which would result in the candidate losing the test booking/fees so no refund shall be given. It would be the candidates’ responsibility to organise/rebook the required tests at the required rate/fee at the time of booking/ subject to availability.

 

23. When a candidate is conducting a Car to Class 1 driver training course with AC Transport Training Ltd, it is at the training instructors’ discretion that the candidate is suitable to advance to category C+E training after a minimum of 4 hours Category C driver training, should the candidate be unsuitable for C+E training then Category C training shall continue which may result in the candidate conducting a Category C test only with no refund to be issued. Category C+E training can be stopped at any time should the instructor have reasonable doubt for the candidate’s ability and or the ability to successfully pass the 3A Off-road exercise/maneuver, should this occur then the course shall continue as a category C with no refund to be issued or training rescheduled. This is in the direct interest of public, candidate and instructor safety, which falls under the Health and Safety requirements for AC Transport Training Ltd.
